Registration:

Consent Required under West Bengal Pollution Control Board

The following are the two consent required under WBPCB:

Consent to Establish (CTE)

In accordance with the terms of the Water (Prevention and Control of Pollution) Act of 1974 and the Air (Prevention and Control of Pollution) Act of 1981, the West Bengal Pollution Control Board must grant consent to establish, or NOC, for all new intended projects, including developments and industrial.

Consent to Operate (CTO)

It is required that all operating units obtain Consent to Operate from WBPCB. This includes those starting operations following a NOC issued by the Board. A CTO must be renewed, and an application must be filed 120 days prior to the previous certificate's expiration. Here are some terms for certain industries that need to apply for renewal-

  • Green Category: 7 years
  • Orange Category: 5 years
  • Red Category: 5 years

Environment Clearance under West Bengal Pollution Control Board

TThe new Environment Impact Assessment (EIA) law was announced by India’s Ministry of Environment, Forest, and Climate Change. The updated EIA notification has made the screening and scoping procedures mandatory.

The projects or activities that require prior environmental clearance are listed in the revised EIA notification schedule. According to the guidelines outlined in the EIA- 2006 notification, the following projects require prior Environmental Clearance (EC)

  • All new projects and activities are outlined under schedule expansion.
  • Modernization and/or expansion of current initiatives
  • If the pollution load is rising, alter the product mix.

All of the projects included in the notice are categorized into two broad groups according to the seriousness of any possible impacts and the susceptibility of the chosen locations.

Category A: After evaluation by the Central Level Expert Appraisal Committee (EAC) and approval from the MoEF and the Government of India an EIA will be necessary.

Category B: The State Environmental Impact Assessment Agency (SEIAA) will carry out the appraisal, and the State Level Expert Appraisal Committee (SEAC) will provide approval, barring instances of special and general conditions. EIA is required for Category B1 as well as Category B2 (EIA not necessary).

Documents required to get Consent Certificates by West Bengal Pollution Control Board

To obtain Consent Certificates (Consent to Establish (CTE) and Consent to Operate (CTO)) from the West Bengal Pollution Control Board (WBPCB), the following documents are generally required:

Validity of NOC by West Bengal Pollution Control Board

The validity period for the Consent to Establish will be seven years for all EIA projects whereas non-EIA projects is five years. Consent to Operate for orange categories shall be ten years, and for green industries, which will have fourteen years of validity.
