The Madhya Pradesh Pollution Control Board is tasked with enforcing the laws regarding protecting the environment in Madhya Pradesh. Madhya Pradesh Pollution Board has been working to control and prevent water and air pollution in the state. The primary function of the board includes granting consent under the Water and Air Act, as well as overseeing environmental law compliance of industries in the state.
The main principle of the MPPCB is to maintain water, air, and soil in healthy and usable conditions for various purposes. There are 2 Zonal Office, 13 Regional offices, and 4 District Office, which are equipped with trained personnel and sophisticated instruments and are constantly keeping watch on environmental activities in the state to attain the objectives.
The Madhya Pradesh Pollution Control Board (MPPCB) is a statutory organization working under the Department of Environment, Forests and Climate Change, Madhya Pradesh State, Govt. of Madhya Pradesh. As an agency of government, it ensures the implementation of environmental laws and standards to check pollution in the state’s environment. MPPCB regularly measures, analyzes and supervises air, water & soil monitoring data, issues PCC (pollution control consent to establish and operate), and checks conformance to environmental norms & standards by the industries. It also provides and implements environmental sensitization programs and also offers policy advice to the government on environmental issues. MPPCB operates under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, promoting sustainable development.
The following are some objectives of MPPCB registration and NOC:
Registration:
The Madhya Pradesh Pollution Control Board grants consent to establish for all new intended projects, including developments and industrial. If an industry or development project does not require environmental clearance from the Government of India, consent to establish. The MPPCB only issues the site-specific CFE order for one particular site.
It is required that all operating units obtain Consent to Operate from MPPCB once the units have been constructed with the required pollution control systems. The CFO is granted for a specific amount of time and must be renewed regularly.
The following are the documents required for consent:
Solid Waste Management Authorisation: Under the Air and Water Acts, the Environment Protection Act, and other regulations, the MPPCB grants authorization for the management of Waste.
Plastic Waste Management Authorisation: The board is in charge of granting permission for PIBOs and plastic waste processors to manage their plastic waste.
EPR Authorisation: under the E-Waste Management Rules, 2016 and the Battery Waste Management Rule, 2022, and the Plastic Waste Management, 2016, the producers, importers, and brand owners (PIBOs) of the product who sell their products on a pan-India basis are required to obtain EPR authorisation from the Central Pollution Control Board (CPCB)
Construction and Demolition (C&D) Waste Management Authorisation: The C&D Waste Management Rules, 2016 govern the management of construction and demolition waste. The MPPCB must grant permission to each C&D Waste Processing facility operating in the state before requiring the annual report to be submitted.
Hazardous Waste Management Authorisation: MPPCB issues an authorisation to entities engaged in the generation, collection, storage, transportation, treatment, use/ processing, or disposal of hazardous wastes in the state
The documents required for obtaining Waste Management Authorization typically vary based on the type of waste (e.g., hazardous waste, biomedical waste, e-waste, plastic waste, construction and demolition waste, or battery waste). The following documents are generally required:
The following is the procedure for getting a consent certificate:
Fill out the outline application from Water/Air consents & Hazardous Waste Authorisation/BMW/Plastic/Solid waste/E-waste through the online portal maintained by MPPCB. The application, together with all technical information and supporting documentation, is submitted online, and the consent fee is determined using an online fee calculator.
R.O. staff reviews the application and the documents and accepts it if found complete in all respects. A request is sent through the online platform for submission of additional information if required. After acceptance, MPPCB sends a request to submit the fee online.
The application is processed online for issuing consent, based on the evaluation. The information about the decision of the MPPCB regarding the grant of consent is conveyed through an SMS alert and the online platform. The applicant receives a text message to download the digitally signed consent as well as a copy of it.
The validity period for the Consent to Establish is a minimum of one year and a maximum of five years. Permission to operate is issued for the balance of the current fiscal year and needs to be renewed on a regular basis after that, the CTO is only available for the last five months of the current fiscal year and needs to be renewed sporadically after that.
The categorization processes have been primarily based on the scale of the industries and resources consumption, and pollution from the release of pollutants and effluents, as well as its anticipated influence on health, hasn't been thought of as the main factor. The purpose of classifying industries into Red, Orange, Green, and White was to determine the best locations for these businesses. Any industrial sector's Pollution Index, or PI, is a number between 0 to 100, and the higher the PI value, the greater the pollution from that sector.
The categories are as follows:
In conclusion, CPCB guidelines are established to prevent and control pollution and to ensure that these guidelines are followed in each state. State boards have been formed and MPPCB is also part of it. Following its obligation, MPPCB ensures to protect the environment by controlling and preventing the pollution released by the establishments. The MPPCB classified the industries into red, orange, green, and white categories for regulation and also issued CTE and CTO certificates to those industries. They provide advice to the state government on pollution prevention and control measures. So if you want to have smooth operations, industries need to obtain clearances from MPPCB.
At Professional Utilities, we leverage our industry knowledge and expertise to help businesses navigate complex regulations, minimize risks, and optimize operations for maximum efficiency and profitability.
The MPPCB is a statutory body established by the Government of Madhya Pradesh. The board is responsible for controlling and preventing water and air pollution in the state of Madhya Pradesh. The board is also responsible for enforcing and monitoring environmental laws and regulations in the state.
The validity of the MPPCB certificate is five years from the date of issue.
The Madhya Pradesh Pollution Registration and Consent Certificate is a document issued by MPPCB to an industrial unit in the state of Madhya Pradesh. To operate lawfully in the state, an industrial unit needs both of these documents.
The four categories into which the MPPCB has divided its industrial activities are A, B, C, and H. A-category industries have the least potential for causing environmental pollution, while the H-category has the most potential for causing environmental pollution.
