Mandatory BIS compliance for Toy Manufacturers & Importers: Explained

On 26th February 2020, the Central Government distributed 'The Toys (Quality Control) Order, 2020', (the 'Request') in exercise of the forces gave under the Bureau of Indian Standards Act, 2016. The Order forces a severe standard prerequisite on the guideline of toys and additionally materials for use in play by youngsters, or different items as advised by the Central Government. The Order has come into power on first September, 2020.




Highlights:-

According to this Order, the toy producers and Importer are under required commitment to consent to the Bureau of Indian Standards ('BIS'), to satisfy the wellbeing guidelines, while fabricating or potentially bringing in the toys. From first September 2020, onwards it will be mandatory for the toy producers/shippers to get the BIS affirmation before selling the toys, in the Indian market. The producers or shippers should follow the standards implied for the wellbeing of toys identified with mechanical and physical properties and so forth as referenced in the Order, additionally, the toys will bear the Standard Mark under a permit, acquired from the Bureau, according to Scheme-I of Schedule-II of BIS (Conformity Assessment) Regulations, 2018.

Enforcement:

The Bureau for example BIS will go about as the ensuring and authorization expert for the merchandise or articles (toys) referred to in the Order. To guarantee the compline with the Order, BIS authority will genuinely review the production line area/fabricating unit. On account of import shipment, the merchandise or articles will be investigated (as tests) to guarantee consistence with the quality/standard.

Applicability:

This Order is applicable to manufacturers manufacturing toys in India as well to the Imports who are importing toys from outside the country. This Order does not apply to goods or articles manufactured/meant for export purposes.

Effect:

From 1st September 2020, no toy manufacturer/importer will be able to sell or import any toys or articles, as mentioned in the Order, without obtaining a certification from the BIS. The Bureau has initiated the process of granting licence/s to the manufacturers of toys for use of BIS Standard Mark as per Scheme I of Schedule II of the BIS (Conformity Assessment) Regulations, 2018.

Registration:

The domestic toy manufacturers and or foreign manufacturers who intend to apply for a BIS licence may follow the process of applying for a BIS licence under the certification scheme, which is available on the BIS website www.bis.gov.in.

For the purpose of BIS certification, toys have been classified into the following two categories:

1. Non Electric Toys (these are ordinary toys such as rattles, dolls, puzzles, etc. which do not have any function dependent on electricity) IS 9873 (Part 1):2019
2. Electric Toys (these are toys which have at least one function dependent on electricity) IS 15644:2006

The manufacturers at the hour of applying for a permit, may pick one of the above material essential norms dependent on the kind of toy for which permit is required. In the event that permit is required for more than one kind of toy, the producer should make singular applications for each sort.
